News: FT Minister Invites Owners Of Illegal Building To A Discussion

Feb 11, 2019

Federal Territories Minister Khalid Abdul Samad called on building owners to approach the Federal Territories Ministry or Kuala Lumpur City Hall (DBKL) once they realise that they have built on government land, reported The Star.

He added that owners of these illegal buildings should not wait until a press conference is held to highlight the matter.

“Tell us your story and we will discuss it and try to find a solution which is acceptable to all parties,” said Khalid.

His statement came following a report on Ali Cafe Tomyam Seafood’s scheduled demolition.

Built at a total cost of RM3 million, the seafood restaurant in Bangsar sits on top of a road divider on road reserve land owned by the Federal Territory of Kuala Lumpur Land and Mines Office.

The restaurant’s demolition was ordered by KL mayor Datuk Nor Hisham Ahmad Dahlan.

Khalid explained that DBKL and his ministry has “no standard approach (to deal with this) – we need to look at it on a case-by-case basis.”

He noted that while some were pretty straightforward, other cases were “complicated”.

“With some structures, the development order has been issued and signed by DBKL. But the land belongs to the government; just like the Medan Imbi case,” he said.

“So it is semi-legal, but built on government land. This should not have happened.”

Once a final decision is made on the case, all parties must accept it including the residents of the area where the property is located.

“The worst case scenario is when the building will have to be demolished and the owners will have to accept that what they have done is wrong,” he said.

Several similar cases in Kuala Lumpur have been highlighted by Khalid last month where illegal structures were built on government-owned spaces.

In these cases, the buildings were put up during the previous administration.
